Terms of Use

Overview

This website is operated by FireMaplegear under the FireMaple brand. Throughout the website, the terms “FireMaple,” “we,” “us,” and “our” refer to FireMaplegear.

FireMaple provides this website, including all information, content, features, tools, products, and services available through it, subject to your acceptance of these Terms of Use and all other policies referenced in them.

By accessing our website, creating an account, or purchasing a product from us, you agree to be bound by these Terms of Use. These Terms apply to all users of the website, including visitors, customers, merchants, vendors, and contributors of content.

Please read these Terms carefully before using the website. If you do not agree to these Terms, you should not access the website or use our services.

Our store is hosted by Shopify Inc., which provides the e-commerce platform through which we offer our products and services.

Nothing in these Terms excludes, restricts, or limits any mandatory consumer rights available under applicable law.

Section 1 – Online Store Terms

By using this website, you confirm that you are at least the age of majority in your country, state, or region of residence, or that you have obtained the consent of a parent or legal guardian where required.

You may not use our website, products, or services for any unlawful or unauthorized purpose.

You must not use the website in a way that violates any applicable law, regulation, intellectual property right, or third-party right.

You must not transmit viruses, worms, malware, destructive code, or other material intended to interfere with the website, its security, or its operation.

A breach of these Terms may result in the suspension or termination of your access to the website or services.

Section 2 – General Conditions

We reserve the right to refuse or restrict access to the website or services where reasonably necessary and permitted by law, including in cases of suspected fraud, abuse, unlawful activity, security risk, or violation of these Terms.

You understand that information you submit through the website, excluding payment card information, may be transmitted across different networks and adapted to meet technical requirements.

Payment card information is encrypted during transmission through the payment systems used by our store.

All content on this website, including text, graphics, product photographs, videos, logos, icons, designs, page layouts, and software, is owned by or licensed to FireMaple and is protected by applicable intellectual property laws.

You may use the website for personal, non-commercial shopping and informational purposes only.

You may not reproduce, copy, distribute, modify, sell, resell, exploit, scrape, or commercially use any part of the website or its content without our prior written permission.

Headings are included for convenience and do not affect the interpretation of these Terms.

Section 3 – Accuracy, Completeness, and Timeliness of Information

We take reasonable steps to provide accurate and current information. However, information on the website may occasionally be incomplete, outdated, or contain errors.

General content on the website is provided for informational purposes and should not replace product instructions, safety warnings, professional advice, or information issued by an appropriate authority.

Historical information may be provided for reference and may no longer be current.

We reserve the right to update or modify website content at any time. Where required by law, we will correct material errors or provide updated information.

Section 4 – Changes to the Service and Prices

Product prices, promotions, discounts, product availability, and website features may change without prior notice before an order is accepted.

A price change will not normally affect an order that we have already accepted, except where there is an obvious pricing error or where applicable law permits or requires a correction.

We may modify, suspend, or discontinue any part of the website or service at any time.

To the extent permitted by law, we are not liable for the modification, suspension, or discontinuation of a website feature that does not affect an existing accepted order or mandatory consumer right.

Section 5 – Products, Availability, and Safety

Certain products may be available exclusively through the website and may be offered in limited quantities.

We make reasonable efforts to display product colors, materials, measurements, specifications, and images accurately. However, colors may vary depending on screen settings, lighting, photography, or manufacturing tolerances.

Product packaging, appearance, components, and specifications may be updated from time to time, provided that such changes do not materially reduce the product’s essential function or quality.

We reserve the right to:

  • Limit sales by customer, household, account, geographic location, or jurisdiction

  • Limit the quantity of products available for purchase

  • Discontinue products

  • Refuse orders that appear to be intended for unauthorized resale or distribution

  • Restrict products where sale or delivery would violate applicable law

Many FireMaple products involve fire, fuel, combustion, pressurized gas, hot surfaces, boiling liquids, sharp components, or other outdoor-use risks.

Before using a product, you must read and follow all instructions, safety warnings, fuel compatibility requirements, maintenance guidance, and local fire or outdoor-use restrictions.

You must:

  • Use only the fuel, adapters, accessories, and components expressly identified as compatible

  • Use the product only in the location and manner permitted by its instructions

  • Never use an outdoor-only appliance inside a home, tent, vehicle, or enclosed space

  • Keep products away from children unless appropriate adult supervision is provided

  • Stop using a product if it appears damaged, leaks fuel, operates abnormally, or presents a safety risk

Product misuse, unauthorized modification, use with incompatible fuel or components, or failure to follow instructions may result in injury or product damage and may affect warranty eligibility.

Nothing in this section excludes or limits any liability or consumer remedy that cannot lawfully be excluded.

Section 6 – Orders and Billing Information

Submitting an order constitutes an offer to purchase the selected products.

An automated order confirmation confirms that we have received your order but does not necessarily mean that the order has been accepted.

We may refuse, limit, or cancel an order before shipment where reasonably necessary, including where:

  • A product is unavailable

  • Pricing or product information contains an obvious error

  • Payment cannot be authorized

  • Fraud or unauthorized payment is suspected

  • Shipping restrictions prevent fulfillment

  • The order appears to be placed by an unauthorized reseller or distributor

  • Fulfilling the order would violate applicable law

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.

We may contact you using the email address, telephone number, billing address, or shipping information provided with the order.

You agree to provide current, complete, and accurate account, billing, shipping, and payment information.

You are responsible for checking that your shipping address, product model, product variation, quantity, and contact information are correct before submitting an order.

Taxes, customs duties, import fees, brokerage fees, and similar charges may apply depending on the destination, unless otherwise stated at checkout or in our Shipping Policy.

Section 7 – Shipping, Cancellations, Returns, and Refunds

Shipping methods, estimated delivery times, shipping charges, customs responsibilities, and delivery restrictions are described in our Shipping Policy.

Order cancellations, voluntary returns, refunds, promotional gift returns, damaged or incorrect items, and any applicable statutory right of withdrawal are governed by our Return & Refund Policy.

Product warranty coverage is governed by our Warranty Information.

The Return & Refund Policy, Shipping Policy, and Warranty Information form part of these Terms.

Nothing in these Terms or our policies excludes, restricts, or limits any mandatory right or remedy relating to faulty, unsafe, damaged, incorrect, misdescribed, or non-conforming goods.

Section 8 – Optional and Third-Party Tools

We may provide access to tools, applications, payment services, tracking services, social media features, or other technology operated by third parties.

We do not control all third-party tools and may provide access to them on an “as available” basis.

Your use of a third-party tool may be governed by the third party’s own terms, privacy policy, fees, and operating rules.

You should review and understand those terms before using the relevant tool.

To the extent permitted by law, we are not responsible for losses caused solely by a third-party tool that is outside our reasonable control.

Section 9 – Third-Party Links

The website may contain links to third-party websites, services, content, or products.

A link does not necessarily mean that FireMaple endorses or controls the third party.

We are not responsible for examining or guaranteeing the accuracy, legality, security, availability, or practices of third-party websites.

Transactions entered into directly with a third party are governed by that third party’s terms and policies.

Products purchased from Amazon, retailers, distributors, or other third-party sellers must generally be handled through the original place of purchase and may be subject to that seller’s policies.

Section 10 – Reviews, Feedback, and User Content

You may submit reviews, photographs, videos, comments, suggestions, questions, or other content where the website permits.

You retain ownership of content that you create. By submitting content to us, you grant FireMaple a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, edit, translate, publish, display, and distribute that content for legitimate business, customer service, product improvement, and marketing purposes.

You confirm that:

  • You own the content or have permission to submit it

  • The content is accurate and based on a genuine experience where it relates to a review

  • The content does not infringe intellectual property, privacy, publicity, or other third-party rights

  • The content is not unlawful, defamatory, threatening, abusive, obscene, fraudulent, or misleading

  • The content does not contain malware, commercial spam, or unauthorized advertising

We may moderate, refuse, edit, or remove user content that violates these Terms or applicable law.

We are not required to keep unsolicited ideas or suggestions confidential, compensate the sender, or implement the submission.

Section 11 – Personal Information

Our collection, use, disclosure, retention, and protection of personal information are governed by our Privacy Policy.

By submitting personal information through the website, you acknowledge that it will be processed in accordance with the Privacy Policy and applicable data protection law.

Section 12 – Errors, Inaccuracies, and Omissions

The website may occasionally contain typographical errors, inaccuracies, or omissions relating to:

  • Product descriptions

  • Specifications

  • Pricing

  • Promotions

  • Availability

  • Shipping charges

  • Delivery estimates

  • Discounts

  • Product images

We may correct errors, update information, or cancel an affected order where reasonably necessary and permitted by law.

If a material error affects an order you have already placed, we may contact you to provide the correct information and allow you to confirm or cancel the affected order.

Nothing in this section limits any mandatory right relating to misleading, incorrect, or incomplete product information.

Section 13 – Prohibited Uses

You may not use the website or its content:

  • For an unlawful, fraudulent, or unauthorized purpose

  • To violate any applicable law or regulation

  • To infringe our intellectual property or the rights of another party

  • To harass, threaten, abuse, defame, discriminate against, or harm another person

  • To submit false, misleading, or fraudulent information

  • To transmit malware, viruses, or destructive code

  • To collect or track another person’s personal information without authorization

  • To send spam, phishing messages, or unauthorized commercial communications

  • To scrape, crawl, copy, index, or extract website data through unauthorized automated means

  • To interfere with or bypass website security, access controls, or technical restrictions

  • To impersonate another person or misrepresent your identity

  • To interfere with the normal operation of the website or another user’s access

We may suspend or terminate access where we reasonably believe that a prohibited use has occurred.

Section 14 – Disclaimer of Warranties and Limitation of Liability

We do not guarantee that access to the website will always be uninterrupted, timely, secure, or error-free.

Website content and digital features are provided on an “as available” basis, subject to any rights or guarantees that cannot lawfully be excluded.

Product warranties, guarantees, and remedies are subject to our Warranty Information and applicable consumer law.

To the maximum extent permitted by law, FireMaple and its affiliates, directors, officers, employees, contractors, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, or consequential losses arising solely from:

  • Temporary website unavailability

  • Loss of data not caused by our failure to use reasonable care

  • Third-party websites or tools outside our reasonable control

  • Unauthorized use of an account caused by the user’s failure to protect account credentials

  • Use of a product contrary to its instructions or safety warnings

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

This includes, where applicable, liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, defective products, or breach of mandatory consumer rights.

Where applicable law does not permit a particular limitation or exclusion, our liability will be limited only to the maximum extent permitted by that law.

Section 15 – Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless FireMaple and its affiliates, directors, officers, employees, contractors, suppliers, and service providers from third-party claims arising directly from:

  • Your unlawful use of the website

  • Your material breach of these Terms

  • Content submitted by you that infringes another party’s rights

  • Your violation of applicable law or a third party’s rights

This section does not require a consumer to indemnify us for losses caused by FireMaple’s own breach, negligence, unlawful conduct, or failure to meet a mandatory legal obligation.

Section 16 – Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law.

The unenforceable portion will be treated as severed, and the remaining provisions will continue in effect.

Section 17 – Termination

These Terms remain effective until terminated by you or by us.

You may stop using the website at any time.

We may suspend or terminate your access if we reasonably believe that you have materially breached these Terms, engaged in fraud, created a security risk, or used the website unlawfully.

Termination does not affect rights, payment obligations, liabilities, orders, or remedies that arose before termination.

Provisions that are intended by their nature to survive termination will remain in effect.

Section 18 – Entire Agreement

These Terms, together with the policies and operating rules referenced in them, constitute the entire agreement between you and FireMaple regarding your use of the website and services.

They replace prior versions of the Terms and prior communications relating to the same subject matter.

Our failure to exercise or enforce a right does not constitute a waiver of that right.

Nothing in this section limits any representation, right, or remedy that cannot lawfully be excluded.

Section 19 – Governing Law and Consumer Rights

These Terms and any separate agreements through which we provide the services shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China, without regard to its conflict-of-law principles.

This choice of law does not deprive consumers of any mandatory protections available under the laws applicable in their country or region of residence.

Nothing in these Terms affects any mandatory right that a consumer may have to bring a claim before a competent court under applicable law.

Section 20 – Changes to These Terms

You may review the current version of these Terms on this page at any time.

We may update these Terms to reflect changes to our services, business practices, legal obligations, or website functionality.

The updated version will be posted on this page with a revised “Last updated” date.

Where required by law, we will provide additional notice of material changes.

Changes will not retroactively reduce rights relating to an order already accepted unless applicable law permits otherwise.

Your continued use of the website after an updated version becomes effective constitutes acceptance of the updated Terms, to the extent permitted by law.
